Terms and Conditions for Clovere-Dublin

Article 1 – Definitions
In these terms and conditions:

  • Cooling-Off Period: The time frame within which a consumer may exercise their right of withdrawal.
  • Consumer: A natural person not acting in the course of a profession or business who enters into a distance contract with the entrepreneur.
  • Day: A calendar day.
  • Ongoing Contract: A distance agreement for a series of products and/or services, with delivery obligations spread over time.
  • Durable Medium: Any device that enables a consumer or entrepreneur to store information addressed to them personally, in a way that allows for future consultation and unchanged reproduction.
  • Right of Withdrawal: The option for the consumer to terminate the distance agreement within the cooling-off period.
  • Entrepreneur: The natural or legal person offering products and/or services at a distance to consumers.
  • Distance Agreement: An agreement made as part of an entrepreneur's organized system for selling products and/or services remotely, where one or more remote communication technologies are exclusively used until the agreement is made.
  • Technology for Remote Communication: A means that can be used to conclude an agreement without the consumer and entrepreneur being in the same place simultaneously.

Article 2 – Applicability
These terms and conditions apply to every offer made by the entrepreneur and to every distance agreement entered into between the entrepreneur and the consumer.

Prior to the conclusion of a distance agreement, the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, it will be stated before the agreement is concluded that the terms and conditions are available for review at the entrepreneur's premises and will be sent to the consumer free of charge upon request.

If the agreement is concluded electronically, the text of these terms and conditions may be provided electronically, in a way that allows the consumer to store them on a durable medium.

Article 3 – The Offer

  • Offers with a limited validity period or conditional terms will be clearly stated.
  • Offers are non-binding, and the entrepreneur reserves the right to amend them.
  • Product descriptions will be accurate and detailed to ensure the consumer can properly assess the offer. Images, if used, will reflect the products and/or services accurately.

Article 4 – The Agreement

  • The agreement is concluded when the consumer accepts the offer and meets its conditions.
  • Electronic acceptance of the offer will be confirmed by the entrepreneur promptly.

Article 5 – Right of Withdrawal
Consumers have the right to withdraw from the agreement without providing reasons within 14 days.

Article 6 – Costs in Case of Withdrawal
The consumer is responsible for return shipping costs. The entrepreneur will refund any payments received within 14 days of withdrawal, provided the product has been received or sufficient proof of return is presented.

Article 7 – Exceptions to the Right of Withdrawal
The right of withdrawal may not apply to:

  • Custom-made products.
  • Perishable goods.
  • Products with broken seals.

Article 8 – Prices
Prices are stated excluding VAT unless otherwise noted.

Article 9 – Compliance and Warranty
The entrepreneur guarantees that products meet the agreement, specifications, and reasonable usability requirements.

Article 10 – Delivery

  • Orders will be processed with the utmost care and delivered promptly.
  • Delivery delays will be communicated within 30 days.

Article 11 – Ongoing Contracts

  • Contracts for indefinite periods can be terminated by the consumer with a maximum one-month notice.

Article 12 – Payment
Payments must be made within seven working days unless otherwise agreed.

Article 13 – Complaints Procedure
Complaints must be submitted clearly and comprehensively within seven days. Responses will be provided within 14 days.

Article 14 – Governing Law
These terms are governed by Irish law, regardless of the consumer's residence.
